If I use NIH grant-funded data but am not a grant awardee, do I have to comply with the public access policy?

Response from NIH: Yes, if you use NIH grant-funded data, you are still required to comply with the public access policy, even if you are not a grantee. NIH requires all grantees to deposit research articles upon acceptance for immediate public availability through PubMed Central.  This policy applies to all NIH-funded research, regardless of whether the data were used or not.  Therefore, if you are using NIH grant-funded data, you must adhere to the public access policy to ensure proper transparency and accessibility of the research findings.
